This warrant ensures that officers have the legal authority to inspect, regulate, and enforce compliance in early years services, safeguarding the welfare and care of children in these settings.

Who Issues the Warrant?

The warrant is issued by the National Service Director of Children’s Services Regulation, currently Fiona McDonnell, under delegated powers. This delegation is grounded in legislation, ensuring that the powers conferred align with all relevant laws, policies, and procedures.

What Does the Warrant Authorise?

An authorised officer holding this warrant is empowered to:

  • Enter and inspect premises providing early years services.
  • Review records and documentation to ensure compliance with care and safety standards.
  • Engage with service providers to address any concerns or non-compliance.

The warrant grants these powers within the geographical area (the Republic of Ireland) of the Child and Family Agency (Tusla).

Legal Obligations for Service Providers

Under Section 58(K) of the Child Care Act 1991, it is an offence to:

  • Refuse entry to an authorised officer acting under their warrant.
  • Obstruct or impede an officer in carrying out their authorised duties.

Service providers must fully cooperate during inspections and reviews to maintain compliance with legal and regulatory standards.
