What is the Alternative Care Inspection and Monitoring Service Warrant?

The Alternative Care Inspection and Monitoring Service (ACIMS) warrant is an official document issued to authorised and designated officers, empowering them to carry out their duties under the Child Care Act 1991 and related regulations. This warrant ensures that officers have the legal authority to inspect, assess, and evaluate the quality of care provided in residential and non-statutory foster care agencies for children.

Who Issues the Warrant?

The warrant is issued by the National Service Director of Children’s Services Regulation, Fiona McDonnell, under delegated authority. This delegation aligns with statutory and regulatory requirements, ensuring compliance with the relevant policies and standards.

What Does the Warrant Authorise?

The holder of this warrant is empowered to:

  • Act as an authorised person under Article 3 of the Child Care (Placement of Children in Residential Centres) Regulations 1995.
  • Serve as a designated person under Article 18 of the Child Care (Standards in Children’s Residential Centres) Regulations 1996.
  • Act as an authorised person under the Child Care (Placement of Children in Foster Care) Regulations 1995, in accordance with Standard 24 of the National Standards for Foster Care (2003).

The authorised officer has the power to:

  • Access files, records, and other relevant information.
  • Interview staff, children, and other relevant persons to evaluate the quality of care provided.
  • Enter either a registered residential care centre or a setting suspected of operating as a residential centre.

These responsibilities are to be carried out in compliance with the specified regulations, care standards, and protocols.

Legal Obligations for Care Providers

Under Part VIII, Section 63 (5) of the Child Care Act 1991, it is an offence to:

  • Wilfully obstruct or interfere with an officer of the agency in the performance of their duties.
  • Fail or refuse to comply with a requirement of the agency or its officers under the regulations.

Care providers are expected to cooperate fully during inspections and assessments to ensure the safety and well-being of children in their care.
