High Court decision to reinstate prosecution against Giraffe Childcare
Tusla – Child and Family Agency welcomes the decision of the High Court to reinstate the prosecution against Giraffe Childcare. In reinstating the case, the President of the High Court, Mr Justice Nicholas Kearns, quashed last month’s decision by the District Court that Tusla did not have the legal standing to take the prosecution.
In response to the High Court decision, Gordon Jeyes, Chief Executive of Tusla, says: “It is imperative that Tusla has at its disposal all legitimate powers to protect the rights of children and, where it feels such rights have been impinged, it is critical that Tusla has recourse to the law to address these matters. I welcome the recent judgment in the High Court reconfirming the fact that Tusla has the powers to hold Early Years Services to account where required in the best interest of children.”
